Benedict’s Law: What Schools Need to Know Before September

From September 2026, Benedict’s Law becomes a legal requirement for all schools in England — marking the biggest change in allergy safety in over a decade.

This new legislation was introduced following the tragic death of five‑year‑old Benedict Blythe, and it places clear, mandatory duties on schools to protect pupils with allergies.

What the Law Requires

Schools must now:

• Publish a whole‑school allergy safety policy • Provide annual allergy & anaphylaxis training to all staff • Hold spare adrenaline auto‑injectors (AAIs) on site • Create Individual Healthcare Plans for every allergic pupil • Appoint a senior leader responsible for allergy safety

This isn’t optional guidance — it’s a statutory duty backed by updated Ofsted inspection criteria.
